New Equipment Warranty
12 Month Manufacturer Warranty
This warranty applies to new equipment supplied by Adkins & Moss Ltd trading as
United Mobility, company number 15442583, from 660 Anlaby Road, Hull, HU3 6UZ.
Warranty period
Unless a longer period is stated in the product documentation, new equipment is
supplied with a 12-month manufacturer warranty commencing on the date of delivery
or collection.
The warranty covers defects in materials and workmanship arising during normal use
of the equipment. It is subject to the manufacturer’s reasonable warranty conditions
and the exclusions set out below.
Some manufacturers may provide a longer warranty for particular products or
components. Where a longer warranty applies, this will be confirmed in the product
documentation or purchase invoice.
Your contract with United Mobility
The manufacturer warranty is provided in addition to your legal rights. Your contract
of sale is with Adkins & Moss Ltd trading as United Mobility, and we remain
responsible for dealing with any rights you may have against us under consumer law.
We will not require you to deal directly with the manufacturer where you are
exercising a legal right against United Mobility. We may, however, contact the
manufacturer or an authorised repairer to arrange an inspection, obtain technical
assistance, supply replacement parts or complete a repair.

components that fail because of a manufacturing defect or defective materials during
the warranty period.
Examples may include:
motors and gearboxes;
controllers and electronic control systems;
joysticks and control panels;
frames and structural components;
manufacturer-supplied chargers;
powered actuators;
wiring and electrical components; and
other non-consumable components forming part of the original equipment.
Coverage is subject to inspection and confirmation that the fault is covered by the
warranty.
Consumables and items subject to wear
Consumable items and components that deteriorate through normal use are not
covered for ordinary wear, depletion, deterioration, punctures or accidental damage.
These items may include:
batteries and the gradual reduction of battery capacity;

solid tyres where wear results from normal use;
brake pads, brake blocks and similar friction components;

other components described by the manufacturer as consumable or service
items.
This exclusion does not apply where a consumable item was defective when
supplied, failed prematurely because of a manufacturing defect, or does not meet the
standards required by law.
Where a battery manufacturer provides a separate or limited battery warranty, any
additional cover will be subject to that manufacturer’s terms. Normal loss of battery
capacity caused by age, charging patterns, temperature, storage or ordinary use is
not considered a manufacturing defect.

The warranty does not cover faults or damage caused by:
normal wear and tear;
accidental or deliberate damage;
misuse, abuse or neglect;
failure to follow the manufacturer’s operating, charging, storage or
maintenance instructions;
overloading or using the equipment outside its stated limits;

is not designed for those conditions;

unauthorised alterations, modifications or repairs;
repairs carried out by anyone other than United Mobility, the manufacturer or
an authorised repairer;
cosmetic damage that does not affect the safe operation of the equipment;
loss or damage occurring during transportation arranged independently by the
customer; or

or United Mobility will repair or replace the defective component within a reasonable
time and without causing significant inconvenience.

the manufacturer and where they provide equivalent functionality and reliability.
If a repair or replacement cannot be completed within a reasonable time, or cannot
be provided without significant inconvenience, you may be entitled to another
remedy under applicable consumer law.
A repair or replacement does not restart the original warranty period unless the
manufacturer confirms otherwise. Any repaired or replacement item will remain
covered for the balance of the original warranty or any longer period required by law.
Inspection and non-warranty work
If inspection shows that the fault is not covered by the manufacturer warranty and is
not covered by your statutory rights, we will explain the reason and may provide an
estimate for chargeable repairs.
We will not carry out chargeable work without your agreement.
A reasonable inspection, call-out, collection or delivery charge may apply where:
no fault is found;

cause; or
the visit or transport relates solely to work outside the warranty and your
statutory rights.
We will tell you about any proposed charge before it is incurred.

with your statutory rights, United Mobility will meet the reasonable and necessary
costs of return, collection, labour, materials and redelivery as required by law.
Where a claim relates solely to additional manufacturer cover, collection, call-out and
transportation arrangements may be subject to the manufacturer’s warranty terms.
We will explain any applicable arrangements or charges before proceeding.
Servicing and maintenance

stated in the purchase agreement.
The customer is responsible for:
following the manufacturer’s operating and maintenance instructions;
charging and storing batteries correctly;
maintaining appropriate tyre pressures where applicable;
reporting faults promptly; and
stopping use where continued operation could be unsafe or cause further
damage.
Failure to maintain the equipment does not automatically invalidate the entire
warranty. However, cover may be refused where a lack of maintenance caused or
materially contributed to the fault.
Statutory rights
This manufacturer warranty is provided in addition to, and does not limit, exclude or
replace, your statutory rights.
Under the Consumer Rights Act 2015, goods supplied to consumers must be of
satisfactory quality, fit for any particular purpose made known to the seller and as

reasonable wear and tear consistent with the equipment’s age and previous

failure to follow the manufacturer’s operating, charging or maintenance
instructions;
damage caused by using unsuitable accessories, chargers or replacement
parts;
damage caused by unauthorised alterations, repairs or attempted repairs;
consumable items or components that naturally deteriorate through use,
unless they were defective when supplied; or
faults arising after the equipment has been used for a purpose for which it
was not designed.
These exclusions apply only to the extent that the excluded act, condition or event
caused or contributed to the reported fault.
Batteries and other consumable components
Used batteries, tyres, inner tubes, upholstery and similar consumable components
may already show signs of use and have a shorter remaining service life than new
components. They are covered only where they fail to meet the condition or
performance expressly stated at the time of sale, or where the customer has rights
under applicable consumer law.
Transport and return costs
This is a return-to-shop warranty. Unless otherwise agreed, the customer is
responsible for arranging and paying for transport of the equipment to and from our
premises when making a claim solely under this voluntary warranty.
This does not affect any legal responsibility we may have to pay reasonable return,
collection or transport costs where the equipment does not meet the standards
required by consumer law. Please contact us before arranging transportation,
particularly for large or heavy equipment.
Statutory rights
This warranty is provided in addition to, and does not limit or replace, the customer’s
statutory rights.

satisfactory quality, fit for any particular purpose made known to the seller and as
described. The standards that may reasonably be expected of used equipment will
take account of factors including its age, condition, price and any faults disclosed
before purchase.
Where used equipment does not meet the standards required by law, the customer
may be entitled to a refund, repair, replacement, price reduction or other remedy.
These rights may continue after this 90-day warranty has expired.
Nothing in this warranty excludes or restricts any right or remedy that cannot legally
be excluded or restricted.
Changes to this warranty
Adkins & Moss Ltd may amend the terms offered with future purchases. Any
amendment will not reduce the warranty rights applying to equipment already
